抄録

本稿は、1971年に公刊されたロールズ『正義論』のなかであまり注目されてこなかった第３部の議論が、『正義論』全体でいかに重要な役割を果たしているかについて、その批判的検討を通じて明らかにするものである。第３部でロールズは、善の理論と正義感覚についての議論を、経済学と心理学という２０世紀後半に著しい発展をみせた経験科学的知見に基づいて展開した。その点に注目して本稿では、ロールズの契約論が『正義論』全体で反照的均衡の方法が展開されているとする解釈に基づいて、その方法論的特徴と第３部の記述的説明に軸足を置いた議論が切り離せないことを確認する。そしてその観点から、第３部で展開される善の理論と正義感覚についての道徳心理学に基づく議論をそれぞれ批判的に吟味し、両者ともに反照的均衡の方法から逸脱していることを明らかにする。結論的には『正義論』の目論見は失敗に終わっていると言わざるを得ないのだが、最近の経験的道徳心理学の進展は、『正義論』で展開された契約論的正義論の再検討・再構築に対し示唆的な一面をもっている。

abstract

This paper purports to reexamine the significance of Part 3 in Rawls’s A Theory of Justice. In Part 3 of A Theory of Justice, Rawls provides the theory of good and the moral psychological account of the sense of justice in the light of the two distinguished empirical sciences, economics and psychology. It can then be seen that the descriptive theories of goodness and the sense of justice are indissolubly associated with the method of reflective equilibrium. By scrutinizing these theories, however, we can see that they fail to meet the conditions of reflective equilibrium. On the other hand, we should admit a possibility of the Rawlsian contract theory of justice if we take the recent development of empirical moral psychology seriously.
