Methods of Jurisprudence

Lawyers and legal scholars who tackle legal issues often debate how courts should interpret relevant statutory provisions. Scholars also discuss, when lawmakers are deliberating new statutory rules to solve a legal issue, what those new rules should be. In such normative legal analyses, what standards or methods do scholars and practitioners use to determine the desirability of a particular interpretation of statutory provisions, or even the desirability of establishing new rules? How do they prioritize the interests of different parties in legal disputes? Are the standards or methods employed in legal analyses particular to jurisprudence, or do they share common features with those in other areas of social science, such as welfare economics, or other disciplines, such as moral philosophy? In this project, we aim to develop both positive and normative analyses of "methods of jurisprudence". In other words, we will discuss what standards or methods are and should be used in legal analyses.
